By accessing or using the website zmedicaltechnologies.com or the TapToSpeak application (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Services.
ZMedical Technologies, LLC ("we," "our," or "us") provides the TapToSpeak application, a text-to-speech communication tool designed to assist patients experiencing temporary speech loss. The app is provided as a progressive web application and may be made available through app stores.
TapToSpeak is a communication aid. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical care. The medical phrases included in the app are for general communication convenience and should not be relied upon for clinical decision-making. Always consult qualified healthcare providers for medical concerns.
You may use the Services for their intended purpose of facilitating communication. You agree not to misuse the Services, attempt to gain unauthorized access to any part of the Services, or use the Services in any manner that could damage, disable, or impair their operation.
Certain features of TapToSpeak use third-party artificial intelligence services, including OpenAI and Anthropic, to generate voice output and provide conversational assistance. These AI-generated outputs are provided for communication convenience and may not always be accurate or appropriate for every situation. You should not rely on AI-generated content for medical, legal, or other critical decisions.
The availability and performance of AI-powered features depend on third-party services that are outside of our control. We do not guarantee the availability, accuracy, or reliability of these features.
TapToSpeak is currently provided free of charge to all users. If we introduce paid features in the future, we will update these terms and provide advance notice. Any in-app purchases made through Apple's App Store or other platforms are subject to the payment terms and refund policies of the respective platform.
All content, design, code, and functionality of the Services are the property of ZMedical Technologies, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, ZMedical Technologies, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to damages arising from communication errors, service interruptions, AI-generated content, or reliance on information provided through the app.
We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we determine, in our sole discretion, violates these terms or is harmful to other users, us, or third parties. You may stop using the Services at any time.
These terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Marion County, Indiana.
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated effective date and version number. Your continued use of the Services after changes are posted constitutes acceptance of the updated terms.
